> Court Grants Injunction on Maryport Nuisance
An Anti Social Behaviour Injunction Order has today been granted by the County Court on a former Maryport resident following an application from Derwent & Solway Housing Association.
Whitehaven County Court granted the Injunction on Mr John Porter, who formerly resided on Moorside Drive, Hillside in Maryport, following a string of anti-social activities within the property and neighbourhood. Mr Porter is currently remanded in Her Majesty’s prison custody for a Grievous Bodily Harm With Intent allegation for alleged involvement in a gang attack in Maryport.
Mr Porter’s actions had caused serious harassment, alarm and distress for residents living in Hillside, Maryport, Cumbria.
An interim Injunction Order was originally applied for by Derwent & Solway Housing Association, a member of Harvest Housing Group in April 2009 when the nuisance was occurring at Hillside. The full Anti Social Behaviour Injunction Order was granted today following a hearing at Whitehaven County Court attended by the Housing Association today. The injunction order excludes Mr Porter from entering the Hillside Housing Estate, Maryport. An Exclusion order requires Mr Porter to not enter a specified area and carries a Power of Arrest, which means that should he breach this civil order, he could be arrested by a police officer. Breaching a civil Anti Social Behaviour Injunction Order could result in a possible fine or imprisonment.

Police Officers worked together, leading to the successful outcome announced today.
Following the granting of the Injunction Order, Robert Porter, Director of Derwent & Solway Housing Association said:
“We take a very strong position in any case of this kind where any of our residents’ lives are disrupted by the behaviour and actions of a neighbour. In granting this Injunction Order, the court has made it possible for residents to continue with their lives free from the unrest this man has caused.”
“We would like to reiterate our position with regards to any incidents of anti-social behaviour, which is that they will not be tolerated. We will continue to work with the relevant authorities to ensure that perpetrators are dealt with effectively.”
Stipulations within the Injunction Order prevent John Porter from: entering the Hillside Housing estate in Maryport, engaging or threatening to engage in conduct causing or likely to cause a nuisance or annoyance to any person with a right to reside in, work in or occupy housing accommodation in the neighbourhood of Hillside, Maryport and from using abusive, insulting or threatening behaviour against them.
