Derwent & Solway Housing Association, a member of Harvest Housing Group, confirmed this week that an emergency Interim Injunction Order was granted against Mr. Nicky Petre on 7 July at Whitehaven County Court. The order was granted under anti social behaviour act legislation, initially for 6 months.

The terms of the order prohibit Mr. Petre from entering the Moorclose, Frostoms and Westfield areas of Workington, from behaving in an anti social manner, using abusive or insulting words and behaviour and from using or threatening to use violence to anyone with a right to visit, work in or reside in the Moorclose and Frostoms area.

The terms of the Interim Injunction Order apply to Moorclose, Westfield and Frostoms and the immediate locality and carry a power of arrest, which means that Mr. Petre will be arrested if found using or threatening to use violence, or if he is found inside the exclusion area. Breaching this Order is contempt of court and can lead to a heavy fine, a prison sentence or both. 

Derwent & Solway Housing Association’s Community Safety Team applied for the Order following a number of reports of harassment and threatening behaviour by Mr. Petre and evidence from Cumbria Police.
 
Following the granting of the Interim Injunction Order, a spokesperson for Derwent & Solway Housing Association said:
“We take any reports of anti-social behaviour within our neighbourhoods very seriously and will always aim to ensure that our residents are able to live free from unrest.  Case Management Officers and Police Officers have worked together regarding this case, leading to the successful outcome”.

A return hearing regarding the case is expected to take place on Thursday 20 August 2009
